In a 4-to-1 decision on Nov. 4, the Criminal Chamber of Mexico's Supreme Court of Justice ruled that the prohibition of consumption and cultivation of cannabis for personal use is unconstitutional, voiding five articles of the country's principal narcotics statute, the General Health Law. The court found that prohibition of cannabis consumption—or of cultivation for non-commercial purposes—violates the right to "free development of the personality," enshrined in Aricle 19 of the Mexican Constitution. The landmark decision only applies to the actual plaintiffs who challenged the prohibition provisions of the General Health Law, but loans weight to legalization proposals being prepared in Mexico's Congress. "They're noting this case and using it in their favor to present a law that will be in agreement and will protect people's rights," Moy Schwartzman, attorney for the plaintiffs, was quoted by AP.

We noted last year that a Seattle-based equity firm is planning to market "Marley Natural" brand cannabis in states where it is legal. Now it seems guitar god Jimi Hendrix is to be thusly immortalized. The San Diego Union-Tribune reports that Toronto-based Nutritional High International Inc announced this week that it has "entered into an exclusive licensing agreement...under which the Company may manufacture and distribute various marijuana and hemp-based edible products using the song titles and bearing the likeness of iconic guitarist Jimi Hendrix." The products in question, to be marketed under the "Edible Experiences" banner, include "Purple Haze" and "Stone Free" lines. (There's already a Purple Haze cannabis strain developed by Dutch growers, although the song was more likely about the LSD experience.) In a cute twist, the "Stone Free" line is to be a preparation infused with CBD—the cannabinoid that is thought to have medicinal value but doesn't actually get you stoned.

Legislators on Capitol Hill passed three amendments June 3 to bar the DEA and Department of Justice from undermining state marijuana laws, as part of the US House of Representatives' consideration of the Fiscal Year 2016 Commerce, Justice, and Science Appropriations bill. "There’s unprecedented support on both sides of the aisle for ending the federal war on marijuana and letting states set their own drug policies based on science, compassion, health, and human rights," said Bill Piper, director of national affairs for the Drug Policy Alliance. "The more the DEA blocks sensible reforms the more they will see their agency's power and budget come under deeper scrutiny."

A bipartisan group of US Senators on March 10 announced legislation to end the federal ban on medical marijuana. The Compassionate Access, Research Expansion and Respect States (CARERS) Act is sponsored by senators Kirsten Gillibrand (D-NY) Rand Paul (R-KY) and Cory Booker (D-NJ). If passed, the bill would end the federal restriction on medical marijuana and allow for several comprehensive reforms, including: permission for limited interstate transport, an expansion of access to cannabis for research purposes, and reclassification of marijuana from Schedule I to II. Medical marijuana, and the right of states to determine how to regulate it, has found bipartisan support in both the House and Senate. (Jurist, March 10)

Virginia Gov. Terry McAuliffe on Feb. 26 signed a legislative measure (HB 1445) permitting use of cannabis oils for patients suffering from severe forms of epilepsy. The bill permits the use of cannabidiol (CBD) and tetrahydrocannabinol acid (THC-A) oils, providing an affirmative defense to charges of possession for those suffering from intractable epilepsy, as long as they have first obtained written permission from a doctor to use the oils. The bill does not permit the cultivation of cannabis plants or establishment of dispensaries, leaving questions as to how patients may obtain the cannabis derivatives. McAuliffe did say he is open to a wider medical marijuana program in the state. (Jurist, Feb. 28; Martinsville Daily, Feb. 27).

The Pinoleville Pomo Nation of Northern California's Mendocino County is set to be the first Native American tribe to grow cannabis, pursuant to the new Justice Department policy taking a hands-off approach to cultivation on Indian reservations. The 250-member tribe signed a contract last month with Kansas-based FoxBarry Farms and Colorado-based United Cannabis to develop a large-scale grow operation on its 99-acre rancheria just north of Ukiah. "We anticipate construction to begin in early February, and operations to commence by the end of the month," Barry Brautman, president of FoxBarry Development Company, told Indian Country Today Media Network. "Our first phase will include 90,000 feet of greenhouse space, and another 20,000 feet of indoor space." FoxBarry will also oversee distribution for California's medical market. Cannabis grown on the rancheria will be distributed only to card-holding medical users and dispensaries. “Our business model involves doing everything legally and by the book,” Brautman emphaszied to the Santa Rosa Press-Democrat.

In the Nov. 4 elections, voters in Washington DC approved Initiative 71, a legalization measure allowing residents to grow up to six plants at home and possess up to two ounces. The victory portends a showdown with Congress, as the Republicans will now control both houses. Oregon approved Measure 91, a legalization measure giving regulatory control to the state liquor control agency and allowing Oregon citizens to grow up to four plants. We continue to await word on a legalization measure in Alaska. A medical marijuana measure in Florida was defeated. Guam became the first US territory to pass a medical marijuana measure. On New Year’s Day, as retail sales of cannabis went legal in Colorado, the state's dispensaries registered well over $1 million in sales. Despite cold and wet weather, most of the 36 shops that opened that day reported long lines, with some customers waiting outdoors for hours. By the end of the first week, by which time another dozen retail outlets had opened, the figure was a whopping $5 million. More than 100 dispensaries in the Centennial State have now received licenses for retail cannabis sales and over 500 are eligible to apply. More are applying every day.

"A new industry is developing in a nascent state in Colorado," says Rachel Gillette, director of the Colorado chapter of the National Organization for the Reform of Marijuana Laws (NORML). "We're not just talking about retail sales, but a lot of other types of business associated with it—construction companies, HVAC contractors, nutrient companies, lighting and equipment sales, packaging, printers, labeling, marketing materials, websites, marijuana tourism, attorneys, payroll companies… This could represent a lot of jobs."
