Insurance companies in Canada are starting to cover medical marijuana, but high costs continue to be an impediment to access in the United States. Even in states that have legalized medicinal use of cannabis, the insurance industry will provide no coverage. Advocates are now starting to demand legislation to address this contradiction.

The results of the Nov. 8 elections really indicate the schizophrenic nature of American political culture at this moment. Amid the fear and loathing over the election of the fascistic Donald Trump as president, big gains were registered for cannabis freedom. Voters in California approved Proposition 64, legalizing  up to an ounce for those 21 and older, and allowing individuals to grow up to six plants. The measure also permits retail sales and imposes a 15% tax. Similar measures passed in Massachusetts, Maine and Nevada, bringing the percentage of Americans living in states where cannabis is legal for adults up from five to 20 percent. Only Arizona's Proposition 205 was rejected by the voters.

Last week, both houses of the New Hampshire legislature voted overwhelmingly to approve a bill permitting doctors to prescribe medical marijuana to many patients with chronic or terminal illnesses. Gov. Maggie Hassan (D-NH) said she would sign the bill. The New Hampshire bill is somewhat less permissive than medical marijuana laws in many other states, with compromise language that denies patients the right to grow cannabis at home, or to use it for post-traumatic stress disorder. The bill also includes restrictions aimed at ensuring that patients do not engage in "doctor shopping" in order to obtain a cannabis prescription. Doctors may only prescribe to those who have been their patients for at least 90 days, and who have already tried other treatments. (Think Progress, June 28)

In a rebuke to the New Hampshire state legislature, Gov. John Lynch on June 21 vetoed medical marijuana legislation for the second time since 2009, despite strong legislative and popular support. SB 409 passed the New Hampshire House by an overwhelming vote of 236-96—more than the two-thirds needed to override the governor's veto. However, because of a narrower margin in the senate, an override is less certain. SB 409 would protect the right of qualifying patients to cultivate their own medical marijuana or designate a caregiver to cultivate it for them, and would limit possession to six plants and six ounces of dried cannabis.

New Jersey lawmakers are set to consider a bill that would decriminalize possession of up to a half ounce of cannabis. The proposal calls for fines of $100 to $500 for possession of up to half an ounce, but no jail time. Possession of drug paraphernalia would result in a $100 fine, and violators who are underage or have multiple convictions would be referred for drug counseling. The proposal is co-sponsored by 15 Democrats and three Republicans. Gov. Chris Christie, a Republican, has proposed mandatory treatment for nonviolent drug offenders rather than jail, and has appropriated $2.5 million for the program. But Democrats want a limited pilot program to see if mandatory treatment really works. (AP, May 17)
